Breeder will microchip puppy and register the litter with the American Kennel Club (AKC) and the United Kennel Club (UKC). Upon completion of the terms of this agreement, the official registration certificate will be provided to Buyer.
Each puppy's registered name will start with "Zaltana's" followed by a word that identifies the litter and then followed by the puppy's name.
Please note: All puppies will be sold with limited AKC registration papers (this means that offspring of this puppy cannot be registered with AKC without my approval).
BUYER'S RESPONSIBILITIES: Please read and initial each block below. Note the words "puppy" and "dog" are used interchangeably:
____If at any future time, the Buyer is unable to keep the above-described dog, Breeder will take this dog back and refund the Buyer 800 US dollars of the purchase price at the Buyer's request. Breeder will assist with transport at the Buyer's request. Buyer must notify Breeder before any action is taken to re-home the dog. The dog may not to be sold, given away, destroyed (euthanized) or placed in an animal shelter. Exception to euthanasia would be if recommended by a veterinarian in the case of injury or suffering of the dog.
____Buyer agrees to provide the breeder Marlene Johnson with a contact number for a person who has been instructed to contact the breeder if something should happen to the buyer (serious illness or death). If buyer wishes to leave the dog to a person of their choice in the event something happens to the buyer, this person needs to be approved by the breeder Marlene Johnson at the time the buyer makes this choice.
____Buyer agrees to remain in regular contact with the breeder and to send pictures of the puppy (at least once every 6 months to update breeder), immediately notify the breeder of any health or temperament problems especially if it concerns a problem that may be of concern to other dogs of that litter. Breeder has the right to exhibit any photos taken of this dog on Breeder's website or blog or any advertising for Zaltana Anatolians.
____The Breeder has made every effort to produce a litter both physically and mentally sound. The Breeder will stand behind this breeding to the extent stated below. However, once the puppy leaves the Breeder, the Buyer accepts full responsibility for the proper care and well-being of the puppy. The Breeder cannot be held responsible for death, injury or deformity of the puppy due to illness, accident or deviation from adequate care normally given a puppy.
____Buyer agrees to take the puppy to a veterinarian within three days of receipt. If for any reason, Buyer is dissatisfied with the health of this puppy, it may be returned to the Breeder within seven days of receipt for a full refund. However, if Buyer elects to keep the pup after the required veterinary exam, Breeder is not liable for any existing or future medical conditions except as noted under "guarantees" below.
____Buyer agrees to continue the vaccination series already started and to arrange for any needed boosters, routine rabies vaccinations and fecal testing/worming. Annual heartworm testing is strongly encouraged. Thyroid testing at 2 years of age and at least every two years after that is strongly recommended as dogs can have low levels without showing any signs of illness. It is recommended that Buyer reviews information provided on Breeder's website in regards to spaying and neutering. Breeder does not recommend these procedures to be done before one year of age. Buyer also acknowledges that they have been informed about AAHA 2006 new vaccination guidelines and agree to discuss these with their veterinarian. Buyer acknowledges that they have been informed that vaccinations in excess of the above mentioned guidelines may lead to vaccinosis-related health and/or behavior problems.
____Buyer acknowledges that he/she has been informed by the breeder that a surgical procedure is available to prevent the development of hip dysplasia in puppies with abnormal x-ray results. This surgical procedure can only be performed between the age of 16 weeks and 20 weeks of age and is called Juvenile Pubic Symphysidesis. Breeder strongly recommends to consider evaluating this puppy's hips at this age and to have this surgery performed if applicable.
____Buyer agrees that this dog shall occupy a suitable fenced area adjacent to Buyer's home and shall never be tied without direct adult human supervision, which means the dog must be within hearing and/or seeing distance of an adult human. This dog shall not be allowed to roam free outside of this fenced area.
____Buyer agrees that this dog shall not be subjected to repetitive, nonproductive verbal or physical corrections or other abuse. Dog shall not be subjected to alpha rolls, scruff shakes, gagging, dangle sticks, drags, a shock collar or choke collarsconsulting with the breeder first before their use. The above may be considered abuse if not used appropriately, and may cause physical and/or emotional damage. Buyer agrees that this dog will not be placed into a facility for "in-kennel training or board and train facilities." Buyer agrees to consult Breeder with any concerns in regards to behavior or temperament.
____Buyer agrees to keep this dog in good condition. Good condition includes but may not be limited to: dog having protection from natural elements such as heat, cold, rain, and pests (such as fleas/flies/ticks etc.); dog should be maintained at an appropriate weight, shall always have access to clean water and be fed a quality diet, and it shall receive adequate care in regards to coat, ear, nail and dental care.
____Buyer agrees to provide adequate socialization and training for this dog as recommended by the Breeder. Breeder will provide the book "Beginning Family Dog Training" by Patricia McConnell when a deposit has been received. Breeder recommends that all buyers read "The Culture Clash" by Jean DonaldsonDonaldson and "The other End of the Leash" also by Patricia McConnell. All of these books have applications for pets and working dogs.
____Buyer agrees to have a plan in place for the event of a natural disaster or the owner's death or inability to care for this dog.
____NOTHING IN THIS AGREEMENT SHALL BE CONSTRUED AS LIABILITY ON THE BREEDER'S PART IF THE DOG SHOULD FAIL TO PERFORM ITS INTENDED FUNCTIONS FOR ANY REASON, NOR SHALL THE BREEDER BE LIABLE FOR ANY ACTIONS OF THIS DOG.
Price: The purchase price is 1,200 US dollars which must be in form of a money order or cashiers check. A non-refundable deposit of 200 US dollars is required to hold a puppy in pick order and will be deducted from the purchase price (The deposit will be refunded if no puppy is available that meets the buyer's request as stated on the "Puppy Application," for example a buyer wanted a female, but no female is available). An additional deposit of 300 US dollars is required in addition to the purchase price and will be refunded as follows (please note that this deposit will not be refunded if this dog has been used for breeding prior to meeting these requirements or if the requirements are not met):

The 300 US dollar deposit will be refunded if buyer provides copies of OFA results of hips and elbows at any time before the puppy reaches 30 months of age.

All funds are due prior to delivery of puppy. The purchase price does not include a crate or any expenses related to transport.

BREEDER'S GUARANTEE: The Breeder guarantees the health and quality of this dog as described below:
Health: Breeder guarantees that this puppy is in good health when leaving the breeder.
Breeder's guarantees in regards to hips and elbows are as follows:
If a diagnosis of hip or elbow dysplasia has been made by the Orthopedic Foundation for Animals (OFA) and a copy of the reading has been furnished to the Breeder, the Breeder will take this dog back and refund the amount stated above or, if Buyer decides to keep the dog, Breeder will refund 600 US dollars.
If the degree of deformity or dysfunction, as described above, is such that the dog must be euthanized (destroyed) before 5 years of age, Buyer must contact Breeder prior to euthanasia and provide contact information for Buyer's veterinarian. Breeder will contact Buyer's veterinarian for a consult and will require a letter from veterinarian regarding recommendation of euthanasia. Buyer will arrange for a veterinary certificate to be forwarded to Breeder as proof of dog's death due to the covered defects. Breeder then agrees to refund the amount as stated above under dog being returned to breeder.
If dog is destroyed without benefit of consult with veterinarian, or written documentation of condition leading to euthanasia, then this guarantee is null and void.
All claims must be made within 30 days of determination of covered defect.
THIS HEALTH GUARANTEE IS NULL AND VOID IF THE DOG HAS BEEN USED FOR BREEDING PRIOR TO OFA RESULTS (at 30 months of age) BEING AVAILABLE, OR IF THE DOG HAS BEEN USED FOR BREEDING IF OFA RESULTS SHOW ABNORMAL HIP OR ELBOW RESULTS, OR IF THE DOG WAS USED FOR BREEDING PRIOR TO 24 MONTHS OF AGE.
QUALITY: The Breeder has made every effort to produce puppies with sound temperaments and to place them into homes that match their individual personalities. If a Buyer is not satisfied with this dog's temperament it can be returned at any time for a refund as stated above.
Jurisdiction and Venue. If any dispute arises between the parties, venue and jurisdiction shall lie with the state and judicial district where Sellers reside. Both parties agree to submit to non-binding mediation prior to filing a suit, each party paying their own attorney fees and one-half the mediation or arbitration fee. In addition to legal relief, a court is hereby authorized to grant injunctive, declaratory or other appropriate equitable relief to enforce both the grant and the limitation of warranties and remedies as set forth by this contract.
Attorney's Fees. In any legal proceeding arising out of this contract, the prevailing party shall be entitled to their reasonable attorney's fees and costs of suit, in addition to any other relief granted by the Court.
Limitation of Damages. In no event shall damages be awarded for the Buyers' incidental or consequential damages of any kind, including, but not limited to, lost profits, or lost production.
Requirement of Timely, Written Notice of Claim. No legal proceedings shall be instituted arising out of this contract unless written notice is delivered by Buyers to Sellers within 36 months of the date of this agreement, which notice shall specify the grounds upon which Buyers assert their claim, and give Sellers reasonable opportunity to respond and offer to cure the alleged breach, if appropriate.
